1. Acceptance of Terms

  • By accessing this website, joining a ride, or participating in any activity organised under The ADV Crew (“the Crew”), you agree to be bound by these Terms & Conditions and by the Crew Rules and Privacy Policy, which are incorporated by reference.
  • If you do not agree with any part of these terms, you must not use this website or participate in any Crew activity.
  • These terms apply to all visitors to this website and to all members, participants, guests, and pillions involved in any Crew ride or event.

2. Nature of the Crew

  • The ADV Crew is an informal community of motorcycle enthusiasts. It is not a tour operator, travel agency, training school, commercial service, or licensed adventure company.
  • Rides and events are organised on a voluntary, non-commercial, best-effort basis. The Crew receives no consideration for arranging them and provides no guarantees of any kind regarding the rides, routes, or outcomes.
  • The Crew does not provide any form of professional advice, route guarantee, mechanical support, medical service, or rescue service.

3. Eligibility

  • You must be at least 18 years of age to join any Crew ride or event.
  • You must hold a valid, current driving licence for the vehicle category you intend to ride and must comply with all local laws regarding motor vehicle operation.
  • Your motorcycle must be roadworthy and carry valid registration, pollution-under-control certification, and third-party (or comprehensive) insurance as required by law.
  • You must be physically and mentally fit to ride the planned route. You alone are responsible for assessing your own fitness, skill, fatigue, and competence before and during a ride. Disclose any condition that may affect your ability to ride safely to the ride captain.
  • We strongly recommend you carry personal accident and medical insurance with adequate coverage for adventure motorcycling before joining any ride.

4. Assumption of Risk

  • You expressly acknowledge that motorcycling, off-road riding, and group travel involve significant, inherent, and unavoidable risks — including but not limited to accidents, collisions, mechanical failure, falls, traffic incidents, animals on the road, weather, road and trail hazards, altitude, fatigue, theft, illness, injury, permanent disability, and death.
  • You voluntarily accept and assume all such risks, whether known or unknown, foreseen or unforeseen, when participating in any Crew activity.
  • You confirm that you are participating of your own free will and that no one has compelled or induced you to join.

5. Code of Conduct & Safety Gear

  • You agree to follow the Crew Rules and all reasonable instructions of the ride captain at all times during rides and events.
  • Helmet, riding gloves, riding jacket with armour, riding pants or knee guards, and proper riding boots are mandatory on every Crew ride. Riders without proper safety gear may be refused participation at the sole discretion of the ride captain.
  • Riding under the influence of alcohol, recreational drugs, or any medication that impairs operation of a motor vehicle is strictly prohibited and grounds for immediate removal from the Crew.
  • You must obey all applicable traffic laws, speed limits, and local regulations. The Crew does not condone or endorse any unlawful riding behaviour.
  • Disrespectful, harassing, discriminatory, or violent behaviour towards fellow riders, locals, residents, or any community will not be tolerated and will result in removal without refund (if any) or further notice.
  • The ride captain's decisions during a ride — including route changes, pace, breaks, refusal of participation, and turnaround — are final.

6. Personal Responsibility & Third Parties

  • You are solely responsible for your own safety, your own equipment, your motorcycle's condition, your route choices, and your decisions on the road.
  • You are solely responsible for any damage or injury you, your motorcycle, or your pillion cause to any third party, including other riders, vehicles, property, animals, or members of the public. The Crew bears no responsibility for any such third-party damage or injury.
  • If you bring a pillion, you are responsible for ensuring they meet the same eligibility, gear, fitness, and conduct requirements as a rider, and that they accept these terms.

7. Release, Waiver & Indemnification

  • To the maximum extent permitted by law, you hereby release, waive, and forever discharge The ADV Crew, its founder, ride captains, organisers, members, volunteers, and contributors (collectively, the “Released Parties”) from any and all claims, demands, liabilities, losses, damages, costs, and expenses of any kind — whether in contract, tort (including negligence), or otherwise — arising out of or in any way connected with your participation in any Crew ride, event, or activity, or your use of this website.
  • You agree to indemnify, defend, and hold harmless the Released Parties against any claims brought by any third party (including your own family, heirs, insurers, employers, or assignees) arising out of or related to your acts, omissions, negligence, or breach of these terms.
  • This release and indemnity apply to the fullest extent permitted by applicable law and survive termination of your participation.

8. Website Content & “As Is” Disclaimer

  • All content on this website — including text, images, logos, videos, design, route descriptions, and any other materials — is the property of The ADV Crew or used with permission and is protected by applicable intellectual property laws.
  • You may not reproduce, modify, distribute, scrape, mirror, or commercially use any content from this website without prior written permission. Sharing the website link itself is welcome and does not require permission.
  • This website and all content on it are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, completeness, or uninterrupted availability.
  • Any route, location, or destination information shown is illustrative only. Road and trail conditions change without notice. You are responsible for independently verifying routes, conditions, and your suitability for them before riding.

9. Photos & Media Consent

  • By participating in any Crew ride or event, you grant The ADV Crew a non-exclusive, royalty-free, worldwide licence to photograph and film you and to use, edit, reproduce, and publish such media on this website, our social channels, and promotional materials for non-commercial community purposes.
  • You may request removal of specific images by contacting us on Instagram, and we will use reasonable efforts to remove them from our owned channels. We cannot guarantee removal from third-party reposts or screenshots outside our control.

10. Limitation of Liability

  • To the maximum extent permitted by law, the Released Parties shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages — including loss of life, personal injury, property damage, loss of profit, loss of data, or loss of enjoyment — arising out of or in connection with your use of this website or your participation in any Crew activity.
  • Nothing in these terms is intended to exclude or limit any liability that cannot be excluded or limited under applicable law.

11. Force Majeure

  • The Crew is not liable for any failure or delay caused by events beyond its reasonable control, including but not limited to weather, natural disasters, road closures, pandemics, government action, civil unrest, strikes, or failure of telecommunications or hosting infrastructure.

12. Membership & Removal

  • The Crew is invitation-based and participation is at the sole discretion of the Crew.
  • The Crew reserves the right to refuse, suspend, or remove any person from any ride, event, or the community at any time, with or without notice, including for breaches of the Crew Rules, safety concerns, or conduct inconsistent with the spirit of the community.

13. Governing Law & Jurisdiction

  • These terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-law principles.
  • Any dispute arising out of or in connection with these terms or your participation in any Crew activity shall be subject to the exclusive jurisdiction of the competent courts located at the Crew's primary place of operation in India.

14. Changes, Severability & Entire Agreement

  • The Crew may modify these terms at any time. The current version will be posted on this page with the date of the last update. Continued use of this website or participation in Crew activities after a change is posted constitutes acceptance of the updated terms.
  • If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
  • These terms, together with the Crew Rules and Privacy Policy, constitute the entire agreement between you and The ADV Crew regarding your use of this website and participation in Crew activities, superseding any prior understanding.
